I depends upon your local Cable Company and what their services offer.

Local channels, most definitely. Nearly all cable providers are required to carry these in the clear. There are a few who have gotten FCC waivers to encrypt local channels. This is primarily Cablevision in Bronx, NY who argued that they are experiencing a lot of service theft and that truck rolls to deactivate subscribers were impractical. Their request may have been reasonable given how difficult it is to deal with landlords in some areas.
Anything beyond that is subject to the cable provider's discretion.
